Some instances are hosted and paid for by people that don’t have lots of money. Purging old posts to save costs is a valid reason to do so. Whether or not that’s the case, I have no idea.

You make it sound like it would be a bad think if the perpetrators got shot and killed for their hate crime. They deserve no better than an untimely end to life.

Plus they have a built in functionality to detect and skip creator ads. Not that if they were actually legally responsible for blocking those that this would be an acceptable solution, but they aren’t, so this is a consumer bonus.

I hate that I’m defending Google here, but I agree the lawsuit is frivolous.

Ianal, but I believe laws like this usually have a “reasonable expectation” component to them. Imo, ad free means Google isn’t injecting their own ads before or during videos, with the exception of ads during live events. I believe they have lived up to that and more with the built in functionality to detect and skip creator ads. I think the explicit writing in the ToS further defends their position, but by itself isn’t a definitive defense. So I think the prosecution has to somehow convince a judge that they were actually deceived by the whole package, the marketing and defend against the very clearly stated section in the ToS. That to me is a tall order and I think Google wins.

My wife and I bought a house about 6 years ago. The previous tenants were going to do a lease to own situation that fell through. When they left the house, they cut all of the power and left it vacant for a couple of months. After we made our offer, I was walking through the house and opened the refrigerator and was presented with about 40 lbs of spoiled meat that was abandoned. The smell was awful and no matter what I did for cleaning, the fridge was never going to bounce back. Due to timing, we moved in before we could address the fridge, so it was still there when we brought our dogs in for the first time. Brutus walked up to the fridge, smelled it, and peed on it. We all just laughed because he was right. He has only had one accident in the house over the past 7 years, and this wasn’t it. We bought a new fridge the next night. Maybe not the funniest thing of all the things our dogs have done, but one of my favorites.
